Torqe (torqe.ai) is a marketing automation platform operated by Ohio Content LLC. We help home service businesses — primarily HVAC contractors — send automated marketing text messages to their existing customers. Torqe integrates with Jobber, the field service management CRM used by our business customers, to import their customer data and run personalized SMS campaigns on their behalf.

This page explains how SMS consent is collected, how messages are sent, and how recipients can opt out. It is provided as public evidence of our consent practices for carrier review and regulatory compliance under the Telephone Consumer Protection Act (TCPA) and 10DLC campaign registration requirements.

How Consent Is Obtained

Torqe uses a two-layer consent model to ensure that every SMS message we send is backed by a legitimate business relationship and an explicit attestation from the sending business.

Layer 1: Existing Business Relationship (EBR). Torqe sends messages only to customers who have a prior transactional relationship with the business owner. These are customers whose phone numbers were collected during the course of requesting, scheduling, or receiving home services — such as HVAC repair, maintenance, or installation. Under the TCPA's Existing Business Relationship framework, a business may send marketing communications to customers with whom they have a prior transactional relationship. Torqe acts as a service provider sending on behalf of the business owner. The business owner contractually attests to the EBR through Torqe's Terms of Service.

Layer 2: Business Owner Attestation. During Torqe's onboarding process at app.torqe.ai, the business owner (the "Account Owner") must explicitly check a TCPA consent attestation checkbox before SMS messaging can be activated. SMS campaigns cannot be sent until this attestation is completed. The business owner cannot proceed without affirmatively checking the consent box — it is not pre-selected.

Customer phone numbers originate from the Account Owner's Jobber CRM, where they were collected during prior service transactions. Torqe does not purchase phone numbers from third parties, does not use scraped or harvested data, and does not send messages to individuals who have not previously engaged with the sending business.

The Onboarding Consent Attestation

During Torqe onboarding, the Account Owner must check the following attestation checkbox before SMS messaging is activated. The checkbox is unchecked by default and must be affirmatively selected. The exact language presented to the Account Owner is:

By checking this box, I confirm that:

  • I am an authorized representative of the business connecting to Torqe
  • I have an existing business relationship with each customer whose contact information will be imported from my Jobber account
  • My customers provided their phone numbers and email addresses to my business in the course of that relationship
  • I understand that Torqe will send automated marketing text messages and emails to these customers on my behalf
  • I agree to Torqe's Terms of Service and Privacy Policy
  • I acknowledge that my customers can opt out at any time by replying STOP, and that Torqe will honor those opt-outs immediately

The "Start Torqe" button is disabled until the Account Owner checks this attestation. Accounts that skip onboarding (using the "Skip and use defaults" option) do not receive TCPA consent and are restricted to email-only campaigns. SMS is never sent without an affirmative attestation on file.

The following are representative examples of the automated SMS messages Torqe sends on behalf of business owners. Every message includes the business name, relevant service context, opt-out instructions, and a message-and-data-rates disclosure.

Dormant Customer Reactivation

Opt-Out and Help Keywords

Recipients can control their messaging preferences at any time by replying with the following keywords. All keyword responses are processed immediately and automatically.

Opt-Out Keywords

Reply with any of the following to immediately stop receiving messages: STOP, STOPALL, CANCEL, END, QUIT, UNSUBSCRIBE, OPTOUT, or REVOKE.

Upon receiving an opt-out keyword, Torqe immediately sends a confirmation message:

You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe.

Opt-outs are permanent and maintained on a suppression list that survives account cancellation and reactivation. A phone number that has been opted out will never receive another message from Torqe, even if the Account Owner cancels and later resubscribes, or if the customer appears in a different Account Owner's Jobber account.

Opt-In Keyword

A user who has previously opted out may reply START to resubscribe. Upon resubscribing, the user receives:

Message Frequency and Rates

Message frequency varies. Campaigns run at most once per week per recipient per campaign type. Message and data rates may apply. Torqe does not charge recipients for messages; standard carrier rates apply.

Sending Hours

All SMS messages are restricted to 9:00 AM – 8:00 PM in the recipient's local time zone, in compliance with TCPA quiet hours. Messages scheduled outside this window are held and delivered at the next eligible sending time.

Dedicated Phone Numbers

Each business on Torqe is assigned a dedicated local phone number. Messages are not sent from shared short codes or toll-free numbers. This ensures recipients can identify and reply to the business that contacted them.

Your Privacy

Torqe takes data privacy seriously. Mobile phone numbers imported from a business owner's Jobber account are used solely to send marketing messages on that business owner's behalf. Mobile phone numbers are never sold, rented, or shared with third parties for their own marketing purposes.

Customer data (including phone numbers) is retained for as long as the Account Owner's subscription is active. After cancellation, data is retained for 90 days to allow for reactivation, then permanently deleted. Suppression records (opt-out requests) are retained indefinitely to ensure we never re-contact individuals who have opted out.
