Privacy Policy

Ohio Content LLC, doing business as Torqe ("Torqe," "we," "us," or "our"), operates the Torqe platform at torqe.ai and app.torqe.ai. This Privacy Policy describes how we collect, use, disclose, and protect information when you use our Service.
Torqe is a marketing automation platform designed for small home service businesses that use Jobber as their field service management software. Torqe is a Jobber Marketplace App. Business owners ("Account Owners") authorize Torqe to access their Jobber data via OAuth, which includes their customers' ("End Users") names, email addresses, phone numbers, physical addresses, and service history. Torqe autonomously runs AI-powered email and SMS marketing campaigns on behalf of Account Owners. Torqe does not access payment or financial data from Jobber.
1. Information We Collect
1.1 Information from Jobber (via OAuth)
When you connect your Jobber account to Torqe through a secure OAuth flow, we access certain data through the Jobber API, including:
- Customer records (names, email addresses, phone numbers, physical addresses)
- Service and job history (service dates, job types, completion status)
- Quote records (services quoted, amounts, status)
- Invoice records (amounts, dates, status)
This data is used solely to identify marketing opportunities (such as dormant customers, maintenance schedules, and open quotes) and to generate and deliver personalized marketing communications on your behalf. We do not access payment or financial data from Jobber.
1.2 Account Information
We collect information you provide during onboarding, including your business name, business address, marketing preferences, and TCPA consent (collected via checkbox with clear disclosure). Authentication is handled through Jobber OAuth — we do not collect or store separate passwords.
1.3 Payment Information
Payment is processed by our third-party payment processor (Stripe). We do not store credit card numbers, bank account numbers, or other payment credentials on our servers.
1.4 Usage Data
When you visit our Site, we automatically collect certain information from your device and the browsers you use. This data helps us understand how you interact with our Site and allows us to improve our Site. We automatically collect; your device's Internet Protocol address (e.g. IP address), browser type and version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.
When you access the Site by or through a mobile device, we may collect certain information automatically, including, but not limited to; the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit our Site or when you access the Site by or through a mobile device.
1.5 Tracking Technologies and Cookies
We use cookies and similar tracking technologies to track the activity on our Site and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our Site. The technologies we use may include:
- Cookies or Browser Cookies. A cookie is a small file placed on your device. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some parts of our Site. Unless you have adjusted your browser setting so that it will refuse cookies, our Site may use cookies.
- Web Beacons. Certain sections of our Site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).
Cookies can be "Persistent" or "Session" cookies. Persistent cookies remain on your personal computer or mobile device when you go offline, while Session cookies are deleted as soon as you close your web browser. We use both Session and Persistent Cookies for the purposes set out below:
- Necessary / Essential Cookies. These Cookies are essential to provide you with services available through the Site and to enable you to use some of its features. They help to authenticate users and prevent fraudulent use of user accounts. Without these Cookies, our Site and its services that you have asked for may not be provided, and we only use these cookies to provide you with those services.
- Functionality Cookies. These cookies allow us to remember choices you make when you use the Site, such as remembering your login details or language preference. The purpose of these Cookies is to provide you with a more personal experience and to avoid you having to re-enter your preferences every time you use the Site.
Some mobile and web browsers transmit "do not track" signals, which send a signal to websites visited by you about your browser's do not track preference settings. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they are even aware of their existence. Our Site is not currently configured to alter its behavior or respond to "do not track" signals, or other mechanisms that may allow you to opt out of the collection of your information across websites.
2. How We Use Your Information
We use the information we collect to:
- Operate and deliver the Service, including identifying dormant customers, generating AI-powered marketing campaigns, and sending emails and text messages on your behalf
- Generate campaign content using artificial intelligence (see Section 4 for details on AI processing)
- Provide weekly and monthly reports on campaign performance and revenue attributed
- Process your subscription payments
- Monitor and improve the reliability, security, and performance of the Service
- Communicate with you about your account, service updates, and support
- Comply with applicable laws, including CAN-SPAM and TCPA
3. Information Sharing
We do not sell, rent, or share your data with third parties for their own marketing purposes. We share information only with the following categories of service providers, solely to operate the Service:
- Email delivery providers (Resend) — to send marketing emails on your behalf. Resend receives the recipient's email address, name, and the email content generated by Torqe.
- SMS delivery providers (Twilio) — to send text messages on your behalf from a dedicated local phone number assigned to your business. Twilio receives the recipient's phone number and the message content. All text messages comply with TCPA regulations, including sending only during permitted hours (9 AM – 8 PM recipient local time) and honoring STOP requests immediately.
- Payment processors (Stripe) — to process subscription payments. We do not have access to your full payment card details.
- AI providers (Anthropic) — to generate marketing content (see Section 4)
- Analytics and monitoring services — to improve service reliability and performance
We may also disclose information if required by law, subpoena, court order, or government request, or if we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
4. Artificial Intelligence and Automated Processing
Torqe uses artificial intelligence (Anthropic's Claude) to generate marketing content, including email bodies, email subject lines, and SMS messages. This content is generated automatically based on campaign type and customer context. AI-generated content is sent on your behalf without manual review, as part of Torqe's autonomous operation. You receive weekly reports showing upcoming campaigns.
We do not transmit full personally identifiable information (such as names, email addresses, phone numbers, or physical addresses) to the AI provider. Content generation uses only anonymized or generalized business and service context (such as "customer last serviced 8 months ago" or "open quote for AC installation"). We access AI services via API only. No customer data is retained by or used to train AI models.
5. SMS and Email Communications
The Service sends marketing emails and text messages to your customers on your behalf, using your business name and identity. You acknowledge that these communications are generated by artificial intelligence and sent automatically.
5.1 Email
- All emails include a CAN-SPAM compliant unsubscribe mechanism
- All emails include your business physical mailing address in the footer
- Unsubscribe requests are honored immediately
- Emails are sent from @torqe.ai on your behalf
5.2 SMS
- All text messages include opt-out instructions (STOP keyword)
- STOP requests trigger an opt-out confirmation and are processed immediately
- Text messages are sent only during permitted hours: 9 AM – 8 PM in the recipient's local time zone, in compliance with the Telephone Consumer Protection Act (TCPA)
- Each business is assigned a dedicated local phone number (not a shared short code)
- TCPA consent is collected during onboarding via checkbox with clear disclosure
6. Data Retention
- Active accounts: We retain your data for as long as your subscription is active.
- After cancellation: Data is retained for 90 days to allow for reactivation, then permanently deleted from our systems.
- Suppression records: Email and SMS suppression records (unsubscribe and STOP requests) are retained indefinitely to ensure we never contact individuals who have opted out, even if your account is later reactivated. This is legally required under CAN-SPAM and TCPA.
- Jobber data: Data synced from Jobber is subject to the retention periods above. We do not retain Jobber data beyond what is necessary to operate the Service.
7. Data Security
We implement industry-standard security measures to protect your data:
- Jobber OAuth tokens are encrypted at rest using AES-256-GCM encryption
- Webhook verification using HMAC-SHA256
- All data is transmitted over TLS
- Secure authentication — we do not store passwords (authentication is handled through Jobber OAuth)
- Access controls ensure each account can only access its own data
8. Your Rights and Controls
You have the right to:
- Access — Request a copy of the data we hold about your account and your customers
- Deletion — Request deletion of your data at any time. Canceling your account will trigger automatic deletion after the 90-day retention period, or you may request immediate deletion by contacting us
- Disconnect — Revoke Torqe's access to your Jobber account at any time through your Jobber account settings
- Opt-out (End Users) — Your customers may opt out of marketing communications at any time by clicking "unsubscribe" in any email or replying STOP to any text message. Opt-out requests are processed immediately
- Data portability — Request an export of your data in a standard format
9. End-Customer (End User) Data
Torqe processes End User data (your customers' information) on your behalf as a data processor. You, the Account Owner, are the data controller for your customers' personal information. You are responsible for ensuring you have the legal right to send marketing communications to your customers and for compliance with applicable privacy laws regarding their data.
End Users who wish to exercise their privacy rights should contact you directly. If we receive a request from an End User, we will direct them to you.
10. Children's Privacy
The Service is designed for business use. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us and we will delete it promptly.
11. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after any changes constitutes acceptance of the updated policy.
